Do I Need to Check Trademarks Registration Before Buying a Domain?

A domain name is used to identify one or more IP addresses. In order to enjoy exclusive rights over the domain name it is required to be trademarked. Thus it is important to check trademark registration before buying a brand name.

Checking trademark registration will help the applicant in determining whether he can use the particular domain name or not. Usually a trademark is not registered as the person already has ownership rights over it. However the holder can obtain various things related to it like logo, brand name or slogan.

In case the desired domain name is already trademarked then the applicant is required to select another brand name in order to avoid infringement of registered brand name. However if a domain name is registered in a particular class then it can be used in other classes in which it is not registered. For example there are 45 classes under the trademark. If a domain name is registered in class 36 then it can be used in every class except class 36.
